COPYRIGHT: too little, too much, just right?

Article:

“Copyright protection - far from being inconsistent with the rights of free speech and freedom of information - is the very engine of free expression.” These words, penned by Supreme Court Justice Sandra Day O’Connor in writing for the majority in Harper & Row Publishers, Inc. v. Nation Enterprises, have been quoted numerous times by those who think the engine is pulling under the strain and stress of the digital cyber world and must be beefed up. Others argue that the engine is a colossal gas-guzzler and must be sent to the scrap heap to be replaced by something lighter and more environmentally friendly, oh yeah, and equipped with a special “Fair Use” package.

Well, the car analogies notwithstanding, the facts are that people situated on both side of this argument are doing all they can to get their point across. As an example, take a new video recently posted on YouTube® …

Running slightly over ten minutes, the video is an attempt to explain the Fair Use provisions of the copyright law and make the case that copyright protection is simply too long. It uses voice and video clips from 27 different Disney and Pixar (Disney distributed) animated features and clearly states that no permission was either attempted or obtained (though it is interesting that the final credit state lists that permission was obtained for the use of a sound recording of a Scott Joplin rag which serves as the film’s background music).

Disney was obviously targeted because of their diligence in protecting their treasured IP (Intellectual Property) - and who can blame them. Still, the film makes a valid point with respect to Fair Use, which provides that, for purposes of Education and Critical Comments, a small portion of a copyrighted work can be used without permission, generally, less than 10%.

Then there’s Mark Helprin’s well-written Op-Ed in the May 20, 2007 edition of the New York Times which presents the idea that copyrights, like real property rights, should last forever! Outrageous, you say? Well, read the piece. His point is well made.

So here we stand: too little…too much… just right? You decide.

P.S. I would be remise if I did not thank Dean Kay, noted songwriter and ASCAP Board member, for first directing my attention to these web postings. Thanks, Dean!

Music Industry Profile: Dave Olsen of Alfred Publishing

Music Industry Profile: Dave Olsen of Alfred PublishingDave Olsen of Alfred Publishing (one of the leading sheet music publishers in the USA) introduces himself and the company he works for. In particular, he describes how the sheet-music business has changed over the past few decades, from a model in which Alfred and others essentially republished sheet music obtained directly from the songwriter, to one in which publishers of sheet music actually transcribe sheet music directly from a finished recording for which written music was never created. He also discusses how electronic transmission is changing how sheet music is distributed, how Alfred’s in-house arrangers do their jobs, how to get your song to a sheet-music publisher like Alfred, what benefits Alfred offers to songwriters whose songs they publish, what music educators and musicians should know about copyright, and much more.

Currently, the arrangers at Alfred Publishing start with an artist’s recording, transcribe the music, and then arrange it for piano, guitar, concert band, orchestra, etc. Dave also discusses the new engraving, printing, and distribution technologies available for print music publications.

What Do Print Music Publishing Arrangers Do?

What Do Print Music Publishing Arrangers Do?Dave Olsen, VP of Business and Legal Affairs at Alfred Publishing, describes different kinds of arrangers and their relationship with publishing companies. Like most publishing companies, there are in-house arrangers on staff who work for Alfred Publishing on a full time basis. Their job is to transcribe recordings and create arrangements for a number of settings including piano, guitar, band, orchestra, etc. There are also independent arrangers who do arrangement projects for print music publishing companies on a freelance basis. Dave also shares the different kinds of deal structures that are used for independent arrangers and who is involved in those agreements.

Submitting Your Music to Alfred Publishing

Submitting Your Music to Alfred PublishingDave Olsen, VP of Business and Legal Affairs for Alfred Publishing, discusses the process of submitting music to publishing companies. Publishing companies are more open to unsolicited material then record companies and if you generate high quality work, there is a fair chance you may get your transcriptions published. If Alfred Publishing decides to publish the work, they enter into a royalty contract with the writer who typically assigns the copyright to Alfred in the process so they can manage the copyrights for them. Publishing companies generally connect the writer with a performing rights organization in order to help manage and collect their royalties.
